PREAMBLE:<\/span><\/b><\/p>\n<p style=\"mso-margin-top-alt: auto; margin-bottom: .0001pt; text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">i. R.P.D. College is committed to provide a healthy, safe and conducive environment that enables employees, and students to work\/study without fear of prejudice, gender bias and any form of Sexual Harassment. Our endeavor is to ensure that every employee and student is treated with dignity and respect and is provided with equal opportunities to professional growth. <\/span><\/p>\n<p style=\"mso-margin-top-alt: auto; margin-bottom: .0001pt; text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">ii. R.P.D. College will not tolerate any form of Sexual Harassment and is committed to take all necessary steps to ensure that its employees and students are not subjected to any form of harassment.<\/span><\/p>\n<p style=\"mso-margin-top-alt: auto; margin-bottom: .0001pt; text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">&nbsp;iii. Therefore, in accordance with \u201cThe Sexual Harassment of Women in Workplace (Prevention, Prohibition and Redressal) Act, 2013\u201d (hereinafter the Act\u2019). With regard to the Supreme Court Judgment and guidelines issued in 1997 to provide for the effective enforcement of the basic human right of gender equality and guarantee against sexual harassment and abuse, more particularly against sexual harassment at work places, the College Grants Commission (UGC) guidelines on prevention of sexual harassment in Universities, has issued circulars since 1998, to all the universities, advising them to establish a permanent cell and a committee; to develop guidelines to combat sexual harassment, violence against women and ragging at the universities and colleges. Keeping the above guidelines in view the R.P.D. College has constituted a Committee against Sexual Harassment (CASH) to provide a pleasant and conducive atmosphere in which our students, teachers and non-teaching staff can work together in an environment free of harassment and exploitation. <\/span><\/p>\n<p style=\"mso-margin-top-alt: auto; margin-bottom: .0001pt; text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">This includes all forms of gender violence, sexual harassment, and discrimination on the basis of gender. Every member is expected to be aware of the commitment to the right to freedom of expression and association. It strongly supports gender equality and opposes any form of gender discrimination and violence.<\/span><\/p>\n<p style=\"margin-bottom: .0001pt; text-align: justify; line-height: 150%;\"><b><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">2. SHORT TITLE AND APPLICATION: <\/span><\/b><\/p>\n<p style=\"line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; mso-bidi-font-size: 11.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">i.<\/span> <span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">This document shall be called the \u201cRPD College Guidelines on Prevention of Sexual Harassment\u201d<\/span><\/p>\n<p style=\"line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">ii. This shall come into effect from the date of approval by the Governing Body of RPD College of Arts and Commerce, Belagavi (Autonomous.<\/span><\/p>\n<p style=\"mso-margin-top-alt: auto; margin-bottom: .0001pt; text-align: justify; line-height: 150%;\"><b><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">3. EXTENT AND APPLICABILITY:<\/span><\/b><\/p>\n<p style=\"text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">This shall be applicable to all types of complaints made in regard to sexual harassment:<\/span><\/p>\n<p style=\"text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">a. By a member of the college against any other member of the college irrespective of whether the harassment is alleged to have taken place within or outside the campus.<\/span><\/p>\n<p style=\"text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">b. By a resident against a member of the college or by a member against a resident irrespective of whether the sexual harassment is alleged to have taken place within or outside the campus.<\/span><\/p>\n<p style=\"text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">c. By an outsider against a member of the college or by a member of the college against an outsider if the sexual harassment is alleged to have taken place within the campus.<\/span><\/p>\n<p style=\"text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">d. By a member of the college, against an outsider if the sexual harassment is alleged to have taken place outside the campus. In such cases the Committee shall recommend that the College authorities initiate action by raising a complaint with the appropriate authority. Further, the Committee will actively assist and provide available resources to the complainant to pursue the complaint.<\/span><\/p>\n<p style=\"mso-margin-top-alt: auto; margin-bottom: .0001pt; text-align: justify; line-height: normal;\"><b><span lang=\"EN-US\" style=\"font-size: 12.0pt; font-family: 'Times New Roman','serif';\">4. DEFINITION OF SEXUAL HARASSMENT:<\/span><\/b><\/p>\n<p style=\"margin-bottom: .0001pt; text-align: justify; line-height: normal;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; font-family: 'Times New Roman','serif';\">&nbsp;<\/span><\/p>\n<p style=\"text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">4.1 Sexual harassment is defined as any one or more of the following unwelcome acts, gestures, or behavior (whether directly committed or by implication) such as:<\/span><\/p>\n<p style=\"text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">a. Physical contact and inappropriate advances, including but not limited to, touching, brushing against the body, leering, staring, and stalking;<\/span><\/p>\n<p style=\"text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">b. A demand or request for sexual favors;<\/span><\/p>\n<p style=\"text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">c. Making Sexually-colored remarks\/comments whether oral or written; including but not limited to, comments about an individual\u2019s body or appearance or attire which are beyond mere courtesy, sexual epithets, indecent jokes, sexually suggestive or insulting comments, innuendos, whistling;<\/span><\/p>\n<p style=\"text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">d. Showing\/sharing pornography or any other objectionable\/offensive material in any form, such as emails, letters, messages, videos, photographs, etc;<\/span><\/p>\n<p style=\"text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">e. Any other unwelcome physical, verbal or non-verbal conduct or gesture of sexual nature<\/span><\/p>\n<p style=\"text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">4.2 When unwelcome sexual advances and\/or verbal, non-verbal, or physical conduct such as lewd comments, remarks or jokes, letters, phone calls or through e-mail or any other communication mediums gestures. Sharing pornographic content, lurid stares, physical contact or molestation, stalking, sounds\/actions of derogatory nature, with the purpose\/effect of interfering with an individual&#8217;s performance or of creating an intimidating, hostile or offensive environment;<\/span><\/p>\n<p style=\"text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">4.3 Unwelcome sexual advances, requests for sexual favours, and\/or verbal or physical conduct of a sexual nature made- either explicitly or implicitly- in return for a term\/condition of teaching\/guidance, employment, participation or evaluation of a person&#8217;s engagement in any college activity;<\/span><\/p>\n<p style=\"text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">4.4 Forcible physical touch or molestation; eve-teasing, sexual innuendos and taunts, physical Confinement against one&#8217;s will and any other act to impinge upon one&#8217;s privacy;<\/span><\/p>\n<p style=\"text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">4.5 Any act or conduct of a person in authority, who denies or would deny equal opportunity in pursuit of education or career development, or otherwise making the environment at the college hostile or intimidating to a person of the opposite\/same sex.<\/span><\/p>\n<p style=\"text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">4.6 Where any of these acts is committed in circumstances where the victim of such conduct has reasonable apprehension, in relation to the victim\u2019s employment or enrolment in the institution whether he\/she is drawing a salary, honorarium or otherwise- such conduct can be humiliating and may constitute as a health and safety issue.<\/span><\/p>\n<p style=\"mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">4.7 It is discriminatory for instance, when the woman has reasonable grounds to believe that her objection would disadvantage her in connection with her employment or work or studentship including recruitment or promotion or academics, when it creates a hostile work environment. Adverse consequences might follow if the victim does not consent to the conduct in question or raises any objection on the same.<\/span><\/p>\n<p style=\"margin-bottom: .0001pt; text-align: justify; line-height: normal;\"><b><span lang=\"EN-US\" style=\"font-size: 12.0pt; font-family: 'Times New Roman','serif';\">5. OBJECTIVES :<\/span><\/b><\/p>\n<p style=\"margin-bottom: .0001pt; text-align: justify; line-height: normal;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; font-family: 'Times New Roman','serif';\">&nbsp;<\/span><\/p>\n<p style=\"mso-add-space: auto; text-align: justify; text-indent: -14.2pt; line-height: 150%; mso-list: l1 level1 lfo1; margin: 0cm 0cm .0001pt 14.2pt;\"><!-- [if !supportLists]--><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman';\">a.<span style=\"font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-size-adjust: none; font-language-override: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-variant-position: normal; font-variant-emoji: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';\">&nbsp;&nbsp;&nbsp; <\/span><\/span><!--[endif]--><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">To comply with the directives of the Honorable Supreme Court of India.<\/span><\/p>\n<p style=\"mso-add-space: auto; text-align: justify; text-indent: -14.2pt; line-height: 150%; mso-list: l1 level1 lfo1; margin: 0cm 0cm .0001pt 14.2pt;\"><!-- [if !supportLists]--><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman';\">b.<span style=\"font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-size-adjust: none; font-language-override: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-variant-position: normal; font-variant-emoji: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';\">&nbsp;&nbsp; <\/span><\/span><!--[endif]--><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">To establish an effective mechanism for the Prevention and Redressal of Sexual Harassment<\/span><\/p>\n<p style=\"margin: 0cm; margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">cases and other acts of gender-based violence at college. <\/span><\/p>\n<p style=\"margin: 0cm; margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">c. To create and foster an environment at the College that is completely free of sexual harassment in its various forms and to generate public opinion against all forms of gender based violence. <\/span><\/p>\n<p style=\"margin: 0cm; margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">d. This is applicable to all allegations of Sexual Harassment made by a student, against a student, employee or third party, irrespective of whether Sexual Harassment is alleged to have taken place within or outside the college premises. <\/span><\/p>\n<p style=\"margin: 0cm; margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">e. The College has constituted a Committee for Prevention of Sexual Harassment to take cognizance of complaints about sexual harassment, conduct enquiries, aid and redressal to the victims, recommend penalties and take action against the harasser, if necessary. <\/span><\/p>\n<p style=\"margin: 0cm; margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">f. The disciplinary action shall commensurate with the nature of the violation and could be in the form of a warning, suspension or even expulsion from the college. <\/span><\/p>\n<p style=\"margin: 0cm; margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">g. To promote a social and psychological environment that will raise awareness about sexual harassment in its various forms.<\/span><\/p>\n<p style=\"margin-bottom: .0001pt; text-align: justify; line-height: normal;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; font-family: 'Times New Roman','serif';\">&nbsp;<\/span><\/p>\n<p style=\"margin-bottom: .0001pt; text-align: justify; line-height: normal;\"><b><span lang=\"EN-US\" style=\"font-size: 12.0pt; font-family: 'Times New Roman','serif';\">6. GUIDELINES:<\/span><\/b><\/p>\n<p style=\"margin-bottom: .0001pt; text-align: justify; line-height: normal;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; font-family: 'Times New Roman','serif';\">&nbsp;<\/span><\/p>\n<p style=\"mso-add-space: auto; text-align: justify; text-indent: -18.0pt; line-height: normal; mso-list: l6 level2 lfo2; margin: 0cm 0cm .0001pt 18.0pt;\"><!-- [if !supportLists]--><b><span lang=\"EN-US\" style=\"font-size: 12.0pt; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman';\">6.1<span style=\"font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-size-adjust: none; font-language-override: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-variant-position: normal; font-variant-emoji: normal; font-weight: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';\">&nbsp; <\/span><\/span><\/b><!--[endif]--><b><span lang=\"EN-US\" style=\"font-size: 12.0pt; font-family: 'Times New Roman','serif';\">Responsibility of the Employees<\/span><\/b><\/p>\n<p style=\"margin-bottom: .0001pt; text-align: justify; line-height: normal;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; font-family: 'Times New Roman','serif';\">&nbsp;<\/span><\/p>\n<p style=\"text-align: justify; text-indent: -18.0pt; line-height: 150%; mso-list: l2 level1 lfo5; margin: 0cm 0cm .0001pt 18.0pt;\"><!-- [if !supportLists]--><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman';\">a.<span style=\"font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-size-adjust: none; font-language-override: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-variant-position: normal; font-variant-emoji: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><!--[endif]--><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">All employees of college have a personal responsibility to ensure that their behavior is not<\/span><\/p>\n<p style=\"margin-bottom: .0001pt; text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">contrary to this policy.<\/span><\/p>\n<p style=\"margin-bottom: .0001pt; text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">b. Employees are encouraged to reinforce maintenance of a safe and healthy work environment, free from Sexual Harassment of any kind.<\/span><\/p>\n<p style=\"margin-bottom: .0001pt; text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">c. Employees must be aware and conscious of not engaging in potential sexual behaviours or incidents at work.<\/span><\/p>\n<p style=\"margin-bottom: .0001pt; text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">d. Employees should watch for and discourage sexual behaviour or any such behaviour, which may have a sexual connotation or is demanding to another person.<\/span><\/p>\n<p style=\"margin-bottom: .0001pt; text-align: justify; line-height: 150%;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; line-height: 150%; font-family: 'Times New Roman','serif';\">e.
